The right to use the invention having been con-
ferred upon the Crown by an Act of the Imperial Parlia-
ment may, in my opinion, be exercised by any Department
of His Majesty's Government in every place within His
Dominions not expressly or necessarily impliedly
excepted.
If the use of the Patent has been "acquired" by
His Majesty's Government the right to use the patent
would by parity of reasoning extend throughout Hig
Majesty's Dominions; unless such right be expressly
restricted to some portion thereof.
It is a serious question whether in the case of
a Colony like HongKong, which is an Imperial Fortress
and Naval Station, as well, and as much, as a Colonial
commercial port, Imperial strategic considerations, and
the general interests of the Empire, do not make it
prejudicial to the general public interests, to grant
such a patent as that granted to the "Marconi Wireless
Telegraph Company."
My own view is that the rights under that patent
may easily and without any possibility of effective
check be exercised to the prejudice of the general pub-
lic interests of the Empire and to a very disastrous
degree.
If that view is sound the Supreme Court could,
and would on petition, revoke the Letters Patent which have been granted here; for a condition of the grant is that if at any time during the term for which the oatent is granted it be made to appear to the Governor that the
